In June 2026, a New York Supreme Court judge ordered the dealer David Nahmad to return a Modigliani painting worth an estimated $30 million to the grandson of a Jewish art dealer who lost it during the Nazi occupation of France. The painting, Seated Man with a Cane (1918), had been bought at auction in 1996 for $3.2 million. It took eleven years of litigation, a trail of archival documents, and the Panama Papers investigation to prove that the painting had been confiscated from Oscar Stettiner's Paris gallery in 1943. The case is a textbook example of why provenance matters. A painting without a documented ownership history is not just a gap in the record. It can be a stolen object, and the people who lost it are still alive.
Provenance is the documented history of ownership of an artwork, from its creation by the artist to its current location. It is a chain of records: bills of sale, auction catalogs, exhibition histories, estate inventories, customs documents, and gallery records that trace who owned the work, when they acquired it, how they acquired it, and what they paid for it. Provenance is the artwork's biography, and it determines two things that are central to the art market: authenticity and legal title.

Provenance research is the process of reconstructing the ownership history of an artwork. Researchers work backward from the current owner, tracing the work through gallery records, auction catalogs, museum accession files, estate inventories, and private collections. The goal is to establish an unbroken chain of ownership from the artist's studio to the present day.
Gaps in provenance are common. Many artworks have undocumented periods, sometimes decades long, where the ownership cannot be verified. Gaps do not necessarily mean the work is stolen or fake, but they raise questions that researchers must answer. A gap during the Nazi period (1933-1945) is treated with particular urgency, because so many artworks were looted from Jewish families during those years.
Provenance researchers use a range of tools. Auction catalogs, which record sales from houses like Christie's and Sotheby's, are primary sources. The catalogue raisonne, a comprehensive annotated listing of an artist's complete works, provides a reference point for tracking individual paintings. Archival documents, including bills of sale, shipping records, and insurance inventories, provide direct evidence of ownership. Technical analysis, including pigment analysis and X-radiography, can support provenance claims by confirming that the materials and techniques are consistent with the attributed artist and period.
Provenance is one of the three pillars of authentication, alongside connoisseurship (the expert evaluation of style and technique) and technical analysis (scientific examination of materials). A strong provenance can confirm that a painting is by the attributed artist. If the ownership chain traces back to the artist's studio or to a dealer who worked directly with the artist, the provenance itself is evidence of authenticity.
Conversely, a weak or fabricated provenance can expose a forgery. The Knoedler Gallery scandal, which unfolded between 2011 and 2019, involved a series of fake paintings attributed to Abstract Expressionist artists including Mark Rothko and Jackson Pollock. The forgeries were sold with fabricated provenance documents that traced the works to a secret collector who did not exist. When the provenance was investigated, the chain fell apart, and the paintings were exposed as the work of a single forger, Pei-Shen Qian, working in a garage in Queens.
The most active area of provenance research today is the restitution of art looted during the Nazi era. Between 1933 and 1945, the Nazi regime systematically confiscated hundreds of thousands of artworks from Jewish families, dealers, and institutions. Many of these works entered museum collections and private collections after the war, sometimes through legitimate-seeming channels such as auctions and estate sales. The ownership histories were incomplete or falsified, and the works remained in their new locations for decades.
The 1998 Washington Conference Principles, adopted by 44 countries, established that museums should research the provenance of works in their collections that changed hands during the Nazi period and return any works that were confiscated by the Nazis to their rightful owners. The principles created a moral obligation, though not always a legal one, and the implementation has been slow and contested.
In July 2026, the German state of Bavaria approved the creation of an independent entity for provenance research and a new panel to evaluate claims for Nazi-looted art. The reform takes provenance research out of museums, where it was previously conducted in-house, and places it in a separate organization attached to the Institut fur Zeitgeschichte in Munich. The Bavarian culture minister, Markus Blume, also announced the return of a 1905 Picasso bronze bust, Fernande/Beatrice, to the heirs of Alfred Flechtheim, a Jewish dealer persecuted by the Nazis. In January 2026, the Prussian Cultural Heritage Foundation (SPK) restituted a Lovis Corinth painting, Eleonore von Wilke (1907), to the heirs of Ismar and Kathe Littmann, a Jewish family forced to sell their collection under Nazi persecution. The painting had been held in trust by the SPK since 1965. For decades, it was unclear whether the painting was a persecution-related loss, because of gaps in the provenance between 1930 and 1937. New research eventually closed the gap, documenting how the painting was used as collateral for a loan and sold under economic duress. In May 2026, a Cezanne watercolour depicting Montagne Sainte-Victoire, on loan to the Fondation Beyeler's Cezanne exhibition in Basel, was identified as a possible Nazi-era loss. Provenance researcher Willi Korte unearthed documents in the Basel public archives showing that the watercolour belonged to Gustav Schweitzer, a Jewish businessman who fled Berlin in 1935. The work was loaned to the Kunsthalle Basel for a 1936 exhibition, and correspondence between the curator and Schweitzer's secretary continued until 1939. The Modigliani Seated Man with a Cane (1918) case is one of the longest-running provenance disputes in recent history. Oscar Stettiner, a Jewish art dealer in Paris, loaned the painting to the Venice Biennale in 1929. After the Nazi occupation of France, Stettiner was arrested and interned in 1943, and his property was sold without his permission. A French court ruled in 1946 that the painting should be returned to Stettiner, but it had already been sold. Stettiner died in 1948 before the painting was found. The work was bought at auction in 1996 by the Nahmad family, who kept it in a Swiss freeport. The Panama Papers investigation revealed that the holding company that owned the painting was controlled by the Nahmads. In April 2026, Judge Joel M. Cohen ruled that the painting must be returned to Stettiner's grandson, Philippe Maestracci. In June 2026, the judge gave Nahmad 30 days to return the work. In 2012, German authorities discovered more than 1,200 artworks in the Munich apartment of Cornelius Gurlitt, the son of a Nazi-era art dealer. The collection included works by Matisse, Chagall, Picasso, and Dix, many of which had been looted from Jewish families. The German government established a task force to research the provenance of the works. By 2019, only a handful of works had been restituted, and Gurlitt had died. The case exposed how much looted art remained in private hands, undocumented and unresearched, decades after the war.
Maria Altmann sued the Austrian government for the return of five Gustav Klimt paintings, including the Portrait of Adele Bloch-Bauer I (1907), which had been confiscated from her family by the Nazis in 1938. The case went to the U.S. Supreme Court, which ruled in 2004 that Altmann could sue Austria in U.S. courts. In 2006, arbitration ordered the return of the paintings. The Portrait of Adele Bloch-Bauer I was subsequently sold to the Neue Galerie in New York for $135 million, at the time the highest price ever paid for a painting. The case, dramatized in the 2015 film Woman in Gold, demonstrated that provenance research and legal persistence could recover looted art even after decades.
Provenance is not only about Nazi-looted art. It matters for every artwork in the market. A strong provenance increases the value of a work because it confirms authenticity and legal title. A gap in provenance, especially during periods of political upheaval, can reduce the value or make the work unsellable. Museums increasingly require provenance research for acquisitions, and collectors are becoming more cautious about works with incomplete ownership histories.
Provenance also matters for cultural property disputes beyond the Nazi era. Greece's claim for the Parthenon Marbles, held by the British Museum, is a provenance dispute. Nigeria's claim for the Benin Bronzes, looted by British forces in 1897, is a provenance dispute. The return of Native American remains and sacred objects under the Native American Graves Protection and Repatriation Act (NAGPRA) is a provenance dispute. In each case, the question is the same: who owned this object, how did they acquire it, and who has the right to possess it now?
